Terms of Sale
**1. APPLICATION**
1.1 These Terms of Sale determine the rights and obligations of the parties in the context of the online sale of Products offered by DYCE MARKETING LLC ("the Company").
1.2 Any Order placed on the website https://themusicpunch.com implies the Customer's prior acceptance, without restriction, of these Terms of Sale, which are subject to the laws of the State of New Mexico. These Terms of Sale are an integral part of the contract between the Customer and the Company. They are fully enforceable against the Customer, who acknowledges having read and accepted them without reservation prior to placing the Order.
1.3 These Terms of Sale apply to any Order placed by an individual of legal age acting as a consumer. The Customer certifies that they are a natural person over 18 years of age, acting for purposes outside the scope of their commercial, industrial, craft, liberal, or agricultural activity. The Customer confirms they have the full capacity to commit themselves when placing an Order and agree to provide truthful information regarding their identity.
1.4 **Exclusion:** Persons acting in a professional capacity, including natural or legal persons, public or private, who act for purposes within the scope of their commercial, industrial, craft, liberal, or agricultural activity, are expressly excluded from the scope of these Terms of Sale. Professionals wishing to place an Order with the Company are invited to contact us directly.
1.5 The terms and conditions applicable to each Order are those in force on the date of payment (or the first payment in the case of multiple payments) of the Order. The Company reserves the right to modify these Terms of Sale at any time by publishing a new version on its website. **2. CONCLUSION OF THE ONLINE CONTRACT**
2.1 **Ordering Process**
To purchase one or more Products on the site, the Customer selects each Product and adds it to their basket. Once the selection is complete, the Customer must confirm their basket to proceed with the Order (1st click).
At this stage, the Customer is redirected to a page containing:
- A summary of the selected Products, their corresponding prices, terms and conditions, and delivery charges. The Customer is responsible for checking and correcting the contents of their basket if necessary.
- The Terms of Sale. The Customer must read them carefully before validating the Order.
This validation of the Order (2nd click) constitutes acceptance of these Terms of Sale and the conclusion of the Contract. The Customer acknowledges that the 2nd click entails a payment obligation.
The Customer is then redirected to the payment page. The Customer can choose a payment method and proceed with payment.
Once the Order has been validated and payment confirmed, the Customer will receive a confirmation email containing:
- A summary of the Order (selected Product, price, terms, and delivery charges);
- The identification of DYCE MARKETING LLC;
- The Order number;
- Terms, conditions, and a withdrawal form.
If the Customer does not receive this confirmation email, they are advised to contact the Company via the contact form on the site.
The Customer will also receive an electronic invoice, which they are advised to retain.
2.2 **Refusal by the Company to Validate the Order**
The Company reserves the right to refuse any Order for legitimate reasons, including but not limited to:
- Non-compliance with these Terms of Sale;
- Quantities ordered not corresponding to normal consumer use;
- Non-payment of a previous Order or ongoing dispute regarding a previous Order;
- Suspicion of fraud (supported by evidence).
**3. PRODUCT SPECIFICATIONS AND AVAILABILITY**
3.1 **Product Specifications**
The essential characteristics of the goods and their respective prices are made available on the Company's website. The Company assumes no liability for errors in these Specifications provided by suppliers. Illustrations, videos, or photos of Products are non-contractual.
3.2 **Availability of Products**
Product offers are valid while supplies last. Availability is indicated on the Product page. If a Product becomes unavailable after the Order is validated, the Company will notify the Customer and refund the amount paid for the unavailable Product. Other Products in the Order will be delivered as planned.
**4. PRICES AND PAYMENT**
4.1 **Prices**
Product prices are displayed on the Product description pages and are exclusive of taxes, including but not limited to sales tax, VAT, and customs duties. Prices are also displayed in USD. The Customer is solely responsible for any additional charges, such as import taxes, VAT, or customs duties, which are not included in the displayed prices.
4.2 **Payment Methods**
Payment can be made using the following methods:
- Credit card (Visa, MasterCard, American Express, etc.);
- PayPal (up to a limit of $1,000);
- Promotional codes or vouchers issued by the Company.
All payments are processed securely.
**5. DELIVERY**
5.1 **Methods and Costs**
The Company provides information about delivery methods and costs before the Customer validates the Order. Delivery costs are included in the final price.
5.2 **Customs Clearance**
The Customer is responsible for import and customs clearance of Products. The Company assumes no liability for customs duties or related taxes.
**6. RETURNS AND REFUNDS**
6.1 **General Policy**
Returns and refunds are governed by the following rules based on the Customer's location:

If the Product is defective or damaged upon receipt, the Customer must contact support@wondertoy.co within 7 days of delivery. Proof such as photos or videos of the defect must be provided. If the claim is validated, the Company will arrange for a replacement or refund.
6.3 **Returns for Customers in the European Union (EU) and the United Kingdom (UK)**
Customers in the EU and UK have the right to withdraw from the purchase within 30 days of receiving the Order. The Product must be returned in its original condition, unused, and with all packaging and accessories. A reconditioning fee of $10 may apply for used or damaged returns.
**Procedure:**

- Refunds will be processed within 14 days of receiving the returned Product.
6.4 **Returns for Other Countries**
For Customers outside the EU, UK, and US, returns are only accepted for defective Products. Customers must contact support@wondertoy.co within 7 days of receipt and provide proof of the defect. Approved returns must be sent to the address provided by Customer Service.
6.5 **Refund Processing**
Refunds will be issued to the original payment method within 7–14 business days after the returned Product is inspected.
6.6 **Exclusions**
Returns or refunds will not be processed in the following cases:
- Products damaged due to misuse or negligence by the Customer.
- Returns made without prior authorization.
- Personalized or custom-made Products.
- Promotional items (e.g., Products purchased on sale or with a discount code).
6.7. **Specific exclusions for promotional items**
Promotional items purchased at a discount or with a reduction are not eligible for return or refund, except in the case of a defective product. By accepting these Terms of Sale, the Customer expressly waives any right of withdrawal or return for such items.

The Company honors legal guarantees of conformity and warranties against hidden defects as required by applicable laws.
